learned in 2011, melvin was slapped with an $11 million tax lien by the irs. the doctor has not returned repeated calls from cnn. menendez acknowledges in a statement that he's flown on the doctor's corporate jet. the doctor has a vacation home at a lush seaside resort in the dominican republic. now, it appears the senate ethics committee may be involved. last fall, it got this e-mail complaint from a new jersey republican state senator asking for an investigation into those caribbean trips. the e-mail complaint questions whether menendez violated the code by quote repeatedly flying on a jet to the dominican republic and other locations and solisitting prostitution. last month, a watchdog group received an allegation he was partying with -- in the dominican republic. the group referred it to the fbi. more recently, a conservative blog published a link to videos of alleged prostitutes making claims against the senator. neither the fbi nor the ethics committee will say whether they are investigating senator menendez. >> very quickly, has he said anything about it? has he outright denied it

on their plans because of the uncertainty of dodd-frank, obamacare cause, tax increases, the president has spent more on economic stimulus and borrow more money than any president in history. his policies are not working and he does not like what business people are telling him. dagen: we talked about this earlier in the show. you look at what happened in the economy during the fourth quarter. we had a contraction if you are on the other side of the aisle don't you look at that and say, hey that is a very reason that the government needs to keep spending money. >> if that helps our economy, we would have the best economy in history. there were no spending cuts in the fourth quarter. we have not executed as a cluster yet. companies did begin to pull back. dagen: one that they are looking for is more infrastructure spending. we have heard that over and over again. why won't the white house get that? >> dagen, it is a different philosophy. the president and his party believe that the government is the central player in our economy. we talk about cutting spending, they think that hurts the economy.

. earnings were down considerably from last year thanks to a tax settlement a year ago. but the results were well above wall street estimates, thanks to a double digit jump in revenues. driving that growth was an increase in deliveries of commercial planes. the 737 remains the driver, with 105 planes delivered. the 777 also helped, as did the 23 dreamliners handed to customers last quarter, but those planes can't fly right now. u.s. and japanese regulators have grounded the 787 due to concerns about its lithium batteries overheating and catching fire. today boeing management said it is making good progress in finding the cause. peter arment is the aerospace analyst at investment firm sterne agee. >> tom: boeing still plans to ramp up production of that dreamliner, triple the number it dlivers and takes payment f. how confident are you it can stick with that? >> we're very confident. i mean, yes, there is no question there is headline risk with the 787. i think that there is concerns about what the ultimate solution will be, or root cause. but everything we have seen, it is a battery defect.

continuing his campaign for extending tax cuts, um, for everyone but the wealthy top brackets, and so we had a fiscal cliff debate and fight on capitol hill where american taxpayers across the country paying their holiday bills were anxiously waiting to see what congress would do, and ultimately everyone but the top earners saw their tax cuts restored. and we went right into a debate about gun control and immigration reform. so it's true that the president has not talked about growth or the economy in a very long time. given this new data, though, and given the fact that we saw an anticipation of these sequestered cuts that the congress passed a long time ago and have the opportunity to undo but haven't yet and are set to go into effect on march 1, in anticipation of those cuts that really hit at defense spending we saw a big shrink in defense jobs, and that is going to continue, um, when we see the sequester go into effect in march. and it's going to hit domestic programs as well. combined that will be, produce a considerable dent to consumer demand. and as we get into a couple months down
